This is a pre-publication draft written during the Tempus GDPR remediation programme. Final copy is pending legal review; the substance will not change materially, but governing-law and venue clauses may be adjusted before launch.
1. Acceptance of these terms
By creating an account or using the Tempus mobile application ("Tempus", "the App", "the Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
2. The service
Tempus helps you track habits, schedule reminders, and generate short motivational phrases. Features may change over time. We may add, remove, or modify features, with notice where changes are material.
3. Account registration
You must provide accurate information when you sign up. You are responsible for safeguarding the phone number and email address associated with your account. You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction if higher.
4. Your content
You retain ownership of the habit names, task notes, custom mood examples, and calendar content you create in Tempus (Your Content). You grant us a limited, revocable licence to store, transmit, and process Your Content solely to operate the Service for you.
When you create a custom mood, Tempus sends your mood name and example phrases to Anthropic (Claude) to generate personalised phrases. See the Privacy Policy for details.
5. Acceptable use
You agree not to:
- reverse-engineer, decompile, or circumvent access controls;
- use the Service to harass, defame, or harm others;
- upload content you do not have the right to upload;
- probe, scan, or test the vulnerability of the Service without our written permission;
- use the Service for any illegal purpose.
We may suspend or terminate accounts that breach this section.
6. Intellectual property
The Service — including its code, design, and generated default motivational phrases — is owned by the Tempus team and is protected by applicable intellectual-property laws. These Terms do not grant you rights to our trademarks or logos.
7. Third-party services
Tempus integrates with Firebase, Supabase, Resend, Anthropic (Claude), RevenueCat, Canny, PostHog, the Apple App Store, and Google Play. Those services are governed by their own terms, which you also agree to by using Tempus or by subscribing to Tempus Pro.
8. Fees and Tempus Pro
8.1 Free tier
Core functionality is free. The free tier supports up to four active habits and one linked calendar. Custom moods are reserved for Tempus Pro; the default moods are available to everyone.
8.2 Tempus Pro subscription
Tempus Pro unlocks unlimited habits, additional linked calendars, and custom mood creation. It is offered as an auto-renewing subscription billed by the Apple App Store (iOS) or Google Play (Android) at the price shown on the in-app purchase sheet at the time you subscribe.
8.3 Billing, renewal, and cancellation
- Apple or Google charges your account when you confirm the purchase and again at the start of each subsequent billing period unless you cancel.
- You can cancel at any time in your platform's subscription settings (Settings → Apple ID → Subscriptions on iOS; Google Play → Payments & subscriptions on Android). Cancellation takes effect at the end of the current billing period — Tempus Pro features remain available until then.
- Refunds are handled by Apple or Google according to their refund policies. We do not issue refunds directly.
8.4 What happens when a subscription lapses
If your Tempus Pro subscription ends, your account is downgraded to the free tier on the next sync. Habits, calendars, and custom moods you created while subscribed are not deleted — they remain in your account but are read-only until you re-subscribe or remove them to fit within the free-tier limits.
8.5 Price changes
We may change Tempus Pro pricing for new subscriptions at any time. For existing subscribers, Apple and Google will notify you of price changes and require your consent before charging the new price.
9. Termination
You can delete your account at any time from Settings. We may suspend or terminate your access for breach of these Terms or for security reasons, with notice where feasible. On termination, the data-retention rules in the Privacy Policy apply.
10. Disclaimers
The Service is provided "as is" without warranties of any kind. Tempus is not a substitute for professional medical, psychological, or fitness advice.
11. Limitation of liability
To the maximum extent permitted by law, the Tempus team is not liable for indirect, incidental, or consequential damages, or for lost data, lost profits, or business interruption arising from your use of the Service.
12. Governing law and venue
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of Amsterdam, except where mandatory consumer law provides otherwise.
13. Changes
We may update these Terms. When we make a material change, we bump the version (shown at the top of this page) and ask you to re-accept inside the app.
